Locklear was arrested in September on suspicion of driving under the influence in Santa Barbara County, Calif. The actress was pulled over by California Highway Patrol after a resident reported that she was driving "erratically."
She was taken into custody where she was tested for drugs and alcohol, but she was later booked and released.
"In talking with her, the officer determines that she seems to be under the influence of something," Patrol spokesman Tom Marshall said at the time.
Earlier in 2008, the actress was treated for anxiety and depression.
