You Don't Mess With the Lo-Tan

A Florida chemist named Jennifer Sunday is no fan of the Lohan tan - she filed suit against the actress and Lohan's business partner for allegedly stealing the formula for fake tanning spray Sevin Nyne. Lohan and Las Vegas businesswoman Lorit Simon launched the product this summer, but an attorney tells the St. Petersburg Times that Sunday created the ingredients - and did not grant permission for their use.
"We are certainly looking for the profits that are being generated right now from that product," Sunday's attorney said. "If Ms. Lohan and Ms. Simon and their companies and their shareholders are profiting from the theft of my client's formula and are profiting from that product, my client is entitled to those proceeds."
The lawsuit, filed in Tampa federal court, targets Lohan, Simon, and Simon's company for breach of contract, theft of trade secrets, civil conspiracy, intentional interference with contractual relations and deceptive and unfair trade practices. A confidentiality agreement with Sunday's company, White Wave International Labs, was signed by Simon in January and is included in the suit.
Skip over this contentThe suit alleges that Sunday and Simon were unable to agree on a price during negotiations over the tanning formula. "The next thing we know, Lorit Simon and Lindsay Lohan are partnering and Ms. Lohan is taking credit for developing this formula, which she indeed had no role in," said Sunday's attorney.
The attorney said Sunday and Lohan have never met. Lohan's representatives have not made a statement about the lawsuit.
