'Grey's' Star Video is 'Not a Sex Tape'

'Grey's Anatomy' star Eric Dane and his wife, actress Rebecca Gayheart, participated in a taped threesome with former beauty queen Kari Ann Peniche, Gawker reports. The 36-year-old Dane, who plays Mark "McSteamy" Sloan on the hit medical drama, steps in front of and behind the camera, while filming the sexcapades in Peniche's apartment.

His lawyers have quickly responded to a leak of the footage, insisting to PEOPLE that it's simply "a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."

The statement continues: "Although the participants are nude, the tape is not a 'sex tape.' It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."

In the footage, Dane, Gayheart and Peniche decide on porn star names and frolic in a jacuzzi, all while the camera is rolling. At one point, Gayheart remarks, "I need to lay down, too. I'm very high."

Sorry darling, I just watch the full version. He is no Tommy Lee, more like Pee Wee. No application to the 10 inch club for him, 6 inch club maybe.

As a man I wanted to check out the wife. I was let down as well. Tits like a 13 yr old boy. Now the beauty queen , not big but nice! No wonder Pee Wee wanted to play with another. This won't help his "sex symbol" status and no porn career ahead either. So sad.:(

Get a grip. This is a personal tape and is really no one elses business. What these three people do in their personal lives is of no concern to others and those that try to butt in need to be put in their place. By legal means if necessary.

This country has enough problems without worrying about who is doing who. Sounds like jealousy to me.

Absolutely changes my opinion of them both. He's absolutely not interesting to me any more. I have no patience with people who do stupid things and then tape themselves doing it. And I'm disgusted with people who think they should indulge themselves in their porno fantasies. People, you really cannot do everything you've ever dreamed of doing without paying a price.

WHO CARES WHAT THEY DO!!! It was in THEIR HOME...not mine, not yours! You want to honestly tell me that any of you and your significant others or spouses haven't tried a few crazy positions or even watched a porn? These people are adults who decided to video tape a night with another person. It is not awful that they did it. What is awful is that someone felt they had the right to exploit the video tape simply because these people are celebrities. I dont think ANYONE has a right to say a darn thing about what these people chose to do in the privacy of their own home. Wouldn't some of you who are commenting be ashamed if some of YOUR private moments were splashed across the internet. Lets not forget--they did not go out and market this video--someone took advantage of them. People in glass houses.....that's all I am saying!

I love how the lawyer says "it was never meant to be seen by the public". Well DUH, none of these sex tapes are meant to get out...they just do. That is the risk you are taking when you make them, that someone other than you will see it. And it is a "sex tape". Does he expect people to believe that three adults just happen to hang out together in the new nude if no sex is involved? Especially love Gayheart saying she is high, classy. Adds a little something special to the whole thing. My guess would be the ex beauty queen leaked the tape since she is the biggest looser of the bunch. She lost her crown and was thrown off Celebrity rehab for sex addiction (go figure).

I really don't care what they do/did. BUT, as usual it displays the stupidity at which lots of people operate. If your a celebrity or wanna be celebrity. Taping your self is the dumbest thing you can do......> But then again Kim Kardashian, Paris Hilton made lots of money being internet whores. And, lets face it. I doubt either of the claims "the tape was stolen". Talentless hacks.

How can anyone make a classy comment on this since it is far from a classy video. They all look and act like they are high. This definitely does not help Eric Dane's career, in my opinion, but it does shed a different light on his character as McSteamy on Grey's Anatomy. Guess he doesn't have to act at all. Making these kinds of videos or pictures may seem like a good idea at the time but they can come back to haunt people later on in life. Best to just say no to being naked on camera. If your kids see it they will be so embarrassed or if you decide to run for public office or any other decent position, you will most likely not fare well.

It's a private tape not a sex tape? No, it's a sex tape that was MEANT to stay private, but if you don't want your junk out there for the world to see, don't film it - enjoy the threesome without the camera - otherwise, serves you right for being SO dumb. Obviously a good looking guy, but his brains are not in the right place! I agree, this will probably hurt his career more than help it - being tabloid fodder didn't do anything for Lindsay Lohan, she is only just now dragging herself out of that mire of publicity - being seen as a slightly sleazy perv is not good for your acting career in general!

sorry to burst your bubble folks, but amateur private sex videos are alive and well, even in our prudist country. all you need to do is search on "swingers" and you'll find all kinds of people who actually ENJOY sex and are not afraid of it. morality is a relative thing and i'm sure YOU don't want their morality shoved down your throat any more than others want YOU to shove it down their's.

How does a private tape get "leaked" out? Either they have given out copies of the tape, or they "leaked" it themselves for publicity. There careers must not be going so well.

This is why it pisses me off they won't allow gays to marry. You already let bisexuals marry but you don't think twice because they "look" like a "normal" heterosexual couple. This is nothing new and it isn't really our business what they do. If it works for them so be it. They could just go and cheat on each other. There are plenty of open marriages/relationships. Some people can love one person but not have sex with just one so why try to act like they can? I personally prefer monogamous relationships although I've had my share of experimenting when I was young and trying to figure out who I was and not who society wanted me to be. They act as if gays would make a mockery of marriage when it's heteros who have accomplished that all on their own.
