The Ukrainian orphan Elton John wants to adopt will not go home with the singer and his longtime partner David Furnish, due to a national law that prohibits unmarried couples from adopting, The AP reports.
The singer toured a hospital for HIV-infected children in Ukraine on Saturday as part of a charity project and said that he and his partner wanted to adopt a 14-month-old, HIV-infected boy named Lev. But the country's Family, Youth and Sports Minister Yuriy Pavlenko said Ukraine does not recognize homosexual unions as marriage.
Pavlenko also said John was too old. The singer is 62 and Ukrainian law requires a parent to be no more than 45 years older than an adopted child.
"Foreign citizens who are single have no right to adopt children ... and the age difference between the adopter and the child cannot be more than 45 years," Pavlenko said. "The law is the same for everybody: for a president, for a minister, for Elton John."
John and Furnish, his longtime partner, tied the knot in 2005 in one of the first legalized civil unions in the United Kingdom.
"I don't know how we do that, but he has stolen my heart. And he has stolen David's heart and it would be wonderful if we can have a home," John said.
Pavlenko said Ukraine was grateful for the singer's charity work and expressed hope that his desire to adopt Lev would spur the domestic adoption of more children with health problems, which is still rare in Ukraine.

Too bad for those children... If someone is willing to take in a child with a diseas most of the world is terrified of.. why worry what kind of "union" they have?? I agree Elton would be considerd old to adopt.. but they are exclucing an entire group because of bias!
I agree-yes he is old but he and his partner clearly have an attachment to this child and it is not as though they are not bright enough to plan for death and who would care for the child if he is not an adult when that time comes. As one who was turned down for an adoption of a disabled child from Guatamala because I had been divorced once (remarried at the time we applied)and finding out that there were no other persons waiting to adopt him (8 years old, could not walk without a walker, unable to control bladder. Botched surgery)I believe that some rules make no sense. I hope they can adopt Lev on medical grounds if for no other reason.
I agree, bottom line @ 62 & in good health, your expected life span would allow a child to reach adulthood. Today alone the obituary show's numerous people in there 20's-40's who have left this world & elton is still here & with his mean's he certainly could raise the child with good medical care & im sure a loving home, but then that country would lose an orphan that has it so much better in an institutional environment.
I agree, he should be allowed to adopt a child, ill or not. Why should it matter if he is married or not, when that child could be given such a wonderful life. There are plenty of married people who make horrible parents. This really pissed me off!
How wonderful when laws spawned by rigid morality lead to an immoral travesty.
I'm sure that child can grow up thankful that Ukraine kept him safe from the Evil Homosexual who would've loved him, taken care of his medical issues, and given him the advantages which come from wealth in Western society.
I agree as well. I do not agree with homosexuality but I also feel that it is up to that person and their God. Many of us have friends or family members that are dishonest or perhaps they have been unfaithful to their spouse or something. It's not up to me to condemn any one. I think that if someone wants to take in a child and give them the love and support we all need to grow into well adjusted members of society I am all for it. Regardless of race, age, religion etc. Not many people will adopt a child with an incureable disease.
If every single child born had someone to love them the world would be a different place. A better place. Just a theory. I am a nanny and I look at the little ones I care for now. They have a host of relatives that love them. Heck, even my family loves them. I wish every child knew what that felt like because every child deserves it. Let's also think about how many children are born to traditional families and mom and dad manage to damage them. We (the world) are responsible for all of the children brought here. Someone needs to love them because God is not pleased with us right now.
I do understand the age stipulation (many adoption agencies and foreign countries have it) but Elton would make an excellent father to that little boy. I don't know how old his partner is but even if they are both 'too old', I'm sure they would make provisions in case they didn't live until the child was 18. What a shame - look at how happy that little guy is being cuddled by Elton. The baby needs a parent. Bend the rules!
SO let me get this straight. The Ukrain with limited resources and sick children in an orphanage are willing to take MONEY from an old gay man...but doesn't think he is good enough to actually CARE for the children? If it weren't for the childrens sake I wouldn't think twice about ending my affiliation with this group of biased people. What a sad state of affairs we live in when two loving people who can give love and the best care to a sick child are banned from that very thing because the were born in a ceratin year and found love that wasn't conventional. That child will never have the love or care that Elton John and his partner can afford and are able to give. Anyone thinking of the children at that place??
I agree it shouldn't matter what "union" someone is in, but rather they are willing to open their home & hearts to children that need permanent homes. However, I'm so tired of celebrities (and regular folks)adopting children from other countries when there are thousands of children in foster care in the U.S.A. that need adoptive homes. In many cases, the state welfare system will actually assist adoptive parents with legal fees that are required for adoption.
Absolutely right Kimberly! On AOL they actually said "has nothing to do with his sexuality" on the headline, how do they figure that? I understand the age issue, but that seems to be listed as a secondary reason. Yeah, much better to let this ill (and unfortunately that means less adoptable) child rot in an orphanage rather than being given a home where he will be taken care of for the rest of his life with loving parents and godparents. What a confused society we live in! I understand people believing the bible says to men shouldn't lie together, but exactly where does it say YOU should be the ones to punish/persecute them, much less an innocent child they could help?
Elton's age alone should disqualify him and his partner from adopting, period. It should have nothing to do with his marital status. Just look at that single, selfish woman from Italy who lied and said she was 55 while getting IVF and conceiving twins. Turns out she was 65, and she passed away at age 69 a few months ago leaving those boys to grow up with relatives. While growing up in an orphanage is the worst option a child could have, even with HIV, he could still outlive Elton and his partner. Then what?
I find this very sad, that this child will suffer due to their choice not to allow Elton John to adopt a child. Sure he's older but this child also has a disease that will as of right now take his life. What does it matter who he is married to he can provide a wonderful life for this baby, unfortunately he may have to spend the rest of his life in a hospital or orphanage.
It was so nice to come here with this controversial issue and have so many lovely encouraging comments posted.
But. Andrea, I'm sorry you don't agree with homosexuality but, at least you seem to have your heart in the right place. By the way, what does it mean to not agree with homosexuality. Since homosexuality can't talk, I assume you can't be having an argument with it. How is it then that you don't "agree" with it.
I know I'm nitpicking a little because I really don't understand what it means.
Homosexuality, as you seem to be implying, is not a choice people make. Hopefully, once people realize this, maybe the dialogue will change.
I completely agree that Elton John should be able to adopt this child. This child would be very well taken care of and would have all the best medical care available. Maybe since he is unable to adopt because of age (though how old is his partner) maybe he could help all those children who are HIV positive by providing better medical care for them and then maybe people wouldn't be so afraid to adopt them. It's not the children's fault that they are HIV positive and the odds of "catching" it is very low as long as you take the correct percautions. Those children are adorable and I wish I could adopt them but I have 2 things against me: 1. I'm a single parent and 2. I'm turning 46 in 10 days. I hope these children find good homes and that they reconsider Elton John's request for adoption.
Kimberly, First I want to say Elton John is one of my favorite song artist from the 70s and 80s But this country needs laws such as these. Children sick or not need to be raised with a male and female role model Which is the way we are created. This is not bias this is fact

You my friend are pathetic. To give love to a very special child is the greatest gift one can give.

Too bad they don't have a foster child program for these kids. It's not permanent but more than likely would end up as such.

So it would be better off for the child to remain and possibly die in an orphanage?
