Eric Dane Sues Over Non-Sex Tape Leak

Eric Dane and Rebecca Gayheart filed a lawsuit today in L.A. County Superior Court against Gawker.com, claiming the site unlawfully posted the private video of their naked non-sex tape, TMZ reports. They want more than $1 million in damages.

In the video, the 'Grey's Anatomy' star and his wife taped their naked escapades with former beauty queen Kari Ann Peniche. During the video, Dane steps in front of and behind the camera, while filming in Peniche's apartment.

In the lawsuit, Dane and Gayheart claim Gawker.com "maliciously" distributed the video and included nude shots of the three. Their lawyer Marty Singer, is also asking for the site to pull the plug on the video.

Last month, his lawyers quickly responded to a leak of the footage, insisting that it's simply "a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."

'Gossip Girl' starlet Leighton Meester is the latest celebrity caught up in a sex tape scandal. According to a TMZ report, a tape of Meester and a boyfriend (and "her very talented feet" ... whatever that means) is being shopped around.

Celebrities....do not make a "non-sex tape", in which you are naked and frolicking with more people than just your wife, if you do not want it made public....simple....duh??!! What about damages for those of us who have had to hear about this tape over & over again while watching entertainment magazine TV shows??...where's our money??

This is only one of the many reasons that I hardly ever watch TV anymore. There does not seem to be anything regular TV that is worth the effort to sit through endless commercials, repeated until they are obnoxious, just to get a tidbit of information like this. I just is not worth the trouble. Of course, PBS Antiques Roadshow.......that's different.

How is it indecent exposure? It was in a private house. Do you want to get arrested for indecent exposure when you take a shower or are getting dressed or even when you are with a loved one in your home? I could see if it was out in public bugt it wasin a private residence.

I think they have every right to film or tape anything they want to with out it being shown to the public. They are all very attractive people, maybe they wanted something taped so when they are no longer that attractive they can look back at how good they had it. Celebrities get all kinds of advantages, but there is nothing that requires them to give up their rights as a result.

Im very surprised at Rebecca Gayheart. She first started on a show callled Loving. I thought she was beautiful and nice but then I heard she did a hit a run and killed someone or hurt them one of the two and now this video. She seems so clean and wholesome and I thought her husband was such a great cute guy, I was surprised he was married being that he is cute he can have anyone maybe thats how she keeps him by having threesomes.

Where did everyone else come from? Let's see....2 stars make a sex tape with another person. (first very ODD mistake and beyond kinky) and then they expect it isn't going to be leaked? OH PLEASE...if your stupid enough to tape yourself having sex verses thinking of your sex life as something personal and special then you get what you get!
My podiatrist butchered my foot during a surgery and I've suffered pain and disfigurment beyond belief, not to mention the financial burdens to travel/hotel/food/boarding pets, to see a specialist who's trying his best to keep me from becoming crippled yet I've been told that because I haven't YET had to have it amputated I have NO CASE against this QUACK...yet these two can sue because they had SEX with a THIRD person and taped it and it somehow was released??????
