'Gossip' Mom Rutherford Gets Restraining Order Over 'Threatening' Ex

'Gossip Girl' actress Kelly Rutherford has been granted a temporary restraining order against her estranged husband, claiming that his presence has been threatening to both Rutherford and her nanny.

In the legal filing, Rutherford claims that Daniel Giersch "has begun to follow me, my mother and my nanny and he shows up unexpectedly to threaten and scare us." TMZ reports. Rutherford also claims that Giersch's behavior and the stress that has been caused by it has affected her breast milk production.

"From time to time I have some extra milk, but I never know when...I believe that the stress Daniel has created for me is also negatively impacting my ability to produce milk," the documents say, E!Online is reporting.

Giersch's lawyer says that the claims are"fabricated accusations," and that "Daniel will remain focused on co-parenting both of their children and not make any personal comments in order to continue to protect the children's need for privacy and well being."

For his part, Giersch said in his own court filing Thursday that Rutherford is the one who's switching up the visits on him. Therefore, he has "immediate concerns that Kelly, her caretakers, and Kelly's mother are causing immediate harm to [their] children."

The restraining order is in effect for 21 days, and Giersch must stay 100 yards away from Rutherford. The couple has two children together: A daughter 2-year-old son Hermes and 3-month-old daughter Helena.

Sounds like soon to be ex-hubby is a STALKER! I really feel for Kelly and her children. I can totally relate to what she is going through. My ex-husband stalked me and even put staples from a staple gun in my tires on my brand new vehicle. This guy needs some serious psychiatric help and needs to be kept away from those children! Otherwise, one day things just might turn tragic.

Her milk production is being affected? Bologney. Sometimes she has "extra milk"? The bottom line is this: Does she have enough to feedher baby, and is the baby gaining weight and growing? You don't have to have "extra milk". There are A LOT of factors that affect milk production---the nutrition of the mother, how much water she drinks and how often and long the baby nurses. Unless her ex is showing up and "scaring and threatening" her while she is breastfeeding, this accusation is crap. Women like Kelly Rutherford make a divorce and child custoday difficult for everyone involved, including the children. Women who use the children as negotiating "pawns" have no respect for themselves, no respect for their children and are egomaniacal control freaks who crave attention. If she wants to avoid her ex-husband, then stay inside your house and nurse your baby!! She says he is "threatening" her and her nanny---has he SAID anything for her justify her statement of him "threatening" her? He has every right to be in a public place as she does. Unless he is breaking into her house and making threats, then I don't see how on earth a judge could have issued a restraining order. If she wants him out of her life and she doesn't want to see him, then stay home. You shouldn't be dragging around a 3-month old baby anyway!! Sounds like this woman is a total drama queen who can't live without some sort of attention. Plus, a restraining order of 100 yards is nothing!! Stay home and breast feed your kid, if you are so worried about your "milk production"---she needs to put some effort into "increasing" her milk production if it is worrying her so much!! This is about the dumbest thing I've ever heard, and shame on that judge. he should have made her pump her breasts out for a few days to see if her "milk production" was affected or not. For her to ASSUME that her milk production is being affected is asinine----how can see say that? Is her baby losing weight? Not growing? Acting hungry after nursing? Not making wet diapers? Perhaps she should get a new excuse and leave the "breast milk" alone. Idiot.

Women will say and do anything to have the upper hand when things go wrong in a marriage. They are TOLD by their lawyers and friends what to say, how to phrase it and act in court. The poor dad is screwed and the kids are stuck with a psycho mother and no father figure. Men in prison get to see their kids more than many dad's out in the world. Remember, it takes two to tango. 99.99% of all dad's would give their lives to defend their kids, not harm them! This woman is a nut, she needs to calm down. I'd worry she would get "stressed out" and drown or kill the kids because of HER nut job brain. She IS nuts!
