You could say that the love some 'Twilight' fans have for the vampire franchise is criminal. In the case of one Chicago woman, it is - literally. According to the Chicago Sun-Times (via EW), a woman spent two nights in jail and faces up to three years in prison for recording the movie 'New Moon' in the theater. But 22-year-old Samantha Tumpach claims she shot only a few minutes of footage, none of which she intended to pirate.Tumpach says she was recording her sister's 29th birthday party, which took place at the theater - much of the tape features her relatives singing "Happy Birthday." A few minutes of the feature film were captured, however, and the young woman was arrested when a theater employee noticed Tumpach recording.
The manager decided to press charges, but Tumpach says, "It was a big thing over nothing. We were just messing around. Everyone is so surprised it got this far."
Officers who examined Tumpach's camera found she had taped "two very short segments" of the movie - no more than four minutes total, Cmdr. Frank Siciliano said.
"You can hear me talking the whole time," Tumpach said. "It was never my intention to record the movie."
Tumpach was taken to bond court on Monday, where a Cook County judge ordered her released on a personal recognizance bond that didn't require her to post monetary bail.
Tumpach will still have to face the felony charge of criminal use of a motion picture exhibition, but as EW points out, the real crime here isn't punishable by the justice system: annoying theatergoers with a powered-up camera in a dark theater.

Rudy, yours is the first post I have read that actually hits the nail on the head concerning the point I was trying to make with the original post....the issue is not if she was talking, singing, jumping around etc or HOW much she was putting other theater goers out...the issue was, as you stated, the 3 yr punishment for something so minor. Rapists and murderers have gotten far less sentences. (Disgusting as it is)The judicial system in this country has gone to hell in a hand basket. And for the record I am a 61 yr old female who loves the Twilight series!!
It shouldn't be a crime to record garbage that is labeled as a movie lol

Why is this a big deal??? You can download movies that have been in the theater in the same week a day or two after they have been out on hundreds of websites..so she got caught?? Big deal..it's not like 'New Moon' is going to suffer in revenue over one little incident. Sorry, this is totally ludicrous. It is no different than dowloading music off the internet.

I Hope she gets LIFE !

The books were poorly written so naturally the only people the whole saga would attract are the teens. The first movie was ridiculously horrible and the second not much better and that is the only crime here. Seriously! How much did the theater employee get for turning the girl in? UM....what would be the motive for doing something so ludicrous? Once everyone realized what she was doing the whole thing should have been dropped...no arrest made, no jail time, and no potenial prison time. Everyone should boycott that theater! Next time, find a better movie to see on your birthday and in a decent theater!

The real crime here should be wasting the courts time and the taxpayers money prosecuting this case. this is WAY BEYOND stupid!

You know what surprises me the most? the fact she thought it was a good idea to bring a damned recorder into the theater in the first place. If this is any indication of her or the groups intelligence then I'm not shocked they were seeing Twilight. They got what they deserved

"I was talking the whole time?" She should get 30 days for talking in a movie theater. Dear movie goers: SHUT UP, if we wanted to hear you talk, we'd call you on the cell phone you did not turn off.

I don't understand all the hype with this movie. I watched the first and was SO bored! I know the 2nd and 3rd will be boring too. Please! Gold glittering vampires? How gay is that? Give me The Lost boys any day! This is a movie for 10 year olds. Waist of film in my opinion!

Sure, at some point everyone breaks a law. Like stealing candy when you're a kid, or speeding when you first get your license, but regardless, it is a law that's been broken. What she did was illegal, even if she claims she wasn't intentionally filming the movie, she still filmed it. She got caught, she's got to face whatever consequence she recieves now. Doesn't matter if millions have already seen it or if you can watch the same amount of time in trailers.
There's nothing really to talk about. She broke a law, got caught. She has only herself to blame.

By TsukiNeutral: "Sure, at some point everyone breaks a law." @#@#@ That just means there are too many laws on the books. A lot of our minor "offenses" are rooted in local governments' insatiable need for new sources of revenue, and many should not be enforced. Those laws are often unConstitutional, but only affect those without the resources to challenge them. In this case, sure the cops should have been called, but after viewing the brief recording, the cops should have been able to tell that the intent of the law wasn't triggered and reasonablethinking would have avoided the arrest and expense of the whole process. I hope the judge throws out the charges so the woman can sue the pants off the theater manager and the owner. They want to make an example? Here it is!
Can someone find out EXACTLY where this theatre is so it can be boycotted? This is ridiculous! That manager must have a miserable and petty existence to press charges over something so stupid. Escort the girl out of the theatre don't press charges.

This is ignorant on both sides. First off this girl is 22 years old she should have known better not to have a camera in the movies. She and her "party" had no respect for other movie goers. And when she was taken in to see the manager they should have asked to see the recording, I don't believe though that they can legally take it and look at it. It may have been her behavior after the fact that caused them to press charges.
The cops had no choice to arrest her, the manager pressed charges.
to the one who asked if it was the first part of the film or what that was recorded, had you read the article it clearly states 2 different segments.
To those of you outraged that it is a 3 year felony - They should have told in this that IF she is convicted that is the maximum sentence under law. she has not been convicted of anything just charged.
I do agree the Management took this way to far. At most I think she should have been kicked out of the theater.

I love how she said, "You can hear me talking the whole time. It was never my intention to record the movie." That to me is the real crime. I mean really, she's talking through the movie and singing Happy Birthday to her sister?! That's probably how she got caught in the first place, someone reported her not for the taping, but for the yapping.

So a birthday celebrated at this movie theater has been a night mare for this girl how sad , I for one would absolutely never go to that theater again ,just to make a statement to that manager who pressed charges, so I guess he will get a bonus now that he gave this girl an arrest record , he is a sorry ass, and should be fired. If this girl was taping the movie to sell it that would be wrong , but 4 minutes of a freakin show to remember a birthday at the movies ,give me a break. What a jerk, Go to another theater and they will be hurting , just like that poor girl. Good luck to her and I hope that people see this and stop entering that theater.

The White House Party crashers are not being punished because it was an inside job....You mean to say that two people can walk right up to how many check points...not be on any list two Secret Service people say no problem...go right in Mr. And Mrs. Tarek Salahi...Just the name alone should have raised eyebrows....First time in 20yrs that the social secretary or someone from that staff was not at the gate with security checking names...HHHMMMM either an inside job or Obama has just brought along his friends who don't know what the hell they are doing!

I would have been totally pissed at the moron filming the party & "talking through the whole thing".
People are so rude in movie theatres & everywhere else these days.
Cell phone should be banned in public places. You should have to go outside & talk just like with cigarettes!!

No crime in what they did. Theatre manager jumped to conclusions. Wrecked a nice birthday, what an A**hole... The true crimes are the snack bar prices. 5 fricken dollars for a HOT DOG? Are they insane? a small coke with lots of Ice, 3 dollars? I can buy two twelve packs for that price. I take Mexican or Chinese food into the theatre, I bring soda or bottled water. What are they going to do, ask me to open my purse? I can refuse, as long as I am not carrying a back pack, it should all be fine. I put my trash in the bins when the movie is over. They charge way too much money and get away with it. The same candy you buy at Walmart for 80 cents they sell it for 4 dollars, only a fool will pay those prices. Not me... never

Yet another example of "keeping the peasants busy" with limitations on everything we do and how we are "doing something criminal", and the REAL criminals are making up all the ridiculous laws in the world to impress upon 'we the people'! THEY drive us straight away into poverty and slavery, while THEY thrive off OUR blood. Talk about your Vampires!
