New Details in Charlie Sheen Domestic Abuse Case

'Two and a Half Men' star Charlie Sheen spent part of Christmas in an Aspen jail cell after he allegedly shoved wife Brooke Mueller. TMZ reports that Mueller told an officer that she was drunk when she called 911 - a claim that law enforcement sources support. Reportedly, both Mueller and Sheen were given blood alcohol level tests, and Mueller's results showed her to be legally intoxicated. While she possibly attempted to recant her story, sources tell TMZ that police currently intend to pursue the case again Sheen.

Police responded to a 911 call regarding a report of domestic violence at 8:34 am. An ambulance was called to the house, but neither Sheen nor the victim - who was not officially named by police - were transported to the hospital. Sheen, 44, was taken into custody on suspicion of second-degree assault and menacing, both felonies, along with criminal mischief, a misdemeanor, Aspen police spokeswoman Stephanie Dasaro told the AP. Sheen was released in the late afternoon after posting $8,500 bond.

Colorado attorney Richard Cummins will be representing Sheen in the case and confirms that a court date has been set for Feb. 8. He tells the AP, "That may be to determine whether a case goes forward or not."

Cummins adds, "I think at the end of the day it will be much ado about nothing. I don't think there's any criminality about what went on."

Sheen's publicist Stan Rosenfield says, "It would benefit everyone not to jump to any conclusion."

TMZ initially reported that Mueller called 911 claiming Sheen assaulted her, but that Sheen told law enforcement that Brooke was the aggressor and he was just fending her off.

Brooke Mueller Sheen gave birth to the couple's first children, twin boys, in March. They married in May 2008 following Sheen's bitter divorce from Denise Richards.

Sheen's screen credits include "Platoon," "Wall Street" and the "Hot Shots!" movies. He nearly died of a drug overdose in 1998 but received court-ordered rehabilitation.

the police arrested him because a drunk lady said he pushed her, are you kidding. Aspen Police have long been viewed as a joke and this just proves they are. Why would the police or anyone else believe her when she was drunk at 8:30 in the morning, think something might be wrong with her, but no arrest the one that will give you the most news coverage. The Police are the ones that should be arrested.

If I could think of one person who portrays the worst character traits both professionally and privately, Charlie Sheen tops the list. His show two and a half men is borderline disgusting and sends the wrong message to many of todays youth. Privately not a year goes by where this guy gets busted for doing something illegal of stupid. I wish sheen would grow-up, use his talent to convey a more moral character and return to the days when he demonstrated that he had the ability to beautifly portray some very challenging characters. What he does now is just moronic fluff.

Let me get this straight. This broad calls the cops on Charlie when she is legally intoxicated and they bust him??? They tested him for alcohol and nothing was said about him being intoxicated, so I must assume he was not. You know they would have jumped all over that if he was. Now the cops/district att ahole wants to proceed with charges. I hope Charlie is vindicated and he sues the crap out of the city of Aspen.

I want that judges personal phone # so that I can demand equal treatment should I decide to beat my wife on christmas day in front of MY children. where is the outrage from Charlies liberal hollywood buddies re: those evil rich folks getting special treatment in the justice system? the rest of us whould have to sit on ice and eat bologny sandwiches until monday. Most of hollywood would be in jail or on skid row, if they didn't have money and lawyers and agents and publicists at their beck and call ready to clean up their messes for them. Right now, in jails all over the country, people are sitting waiting for a bail bondsman for lesser offenses. Charlie is a victim of being a good looking, heterosexual white man, the new minority. He actually is very cool, and down to earth, and is never too big to hang with the simple people of the world. I had such an occasion at a boat marina and he was very nice, never made me feel like I had to kiss his ass. Why oh why would he marry again is beyond me. I'm going through my one and only divorce. Luckily we are both remaining friends (my ex and I). This guy has to go back to the old bachelor days of find 'em, 'f*** 'em, and forget 'em. There's a lot of pu**y out there.
