'The Deadliest Catch' star Jake Harris wasn't drinking when he was busted for a DUI, according to his lawyer.

"He didn't have a sip of alcohol," his lawyer Ed Ritter told PEOPLE, ruling out drug use as well.

Ritter explained the sensational arrest stemmed from "an anonymous caller who alleged (Harris) was driving erratically." The lawyer insisted "there's no evidence of that."

Harris' traffic arrest came on the heels of the tragic news that his father, Capt. Phil Harris, had died from complications of a stroke on Feb. 9. The unexpected death brought national mourning over the larger-than-life fishing captain from the reality television series.
