Does Jesse James' Porn Star Ex Have a Real Shot at Regaining Custody?

Sandra Bullock helped raise Jesse James' 6-year-old daughter, Sunny, while the girl's mother, porn star Janine Lindemulder, was in jail for tax evasion. Now, despite having lost a custody battle just last December, she is renewing the fight. TMZ is reporting that Lindemulder has filed legal documents as a direct result of James' affair with tattoo model Michelle "Bombshell" McGee.

But even if James slept with a Nazi fetishist, does it give a longtime porn star a decent shot at custody? For an expert opinion, PopEater chatted with J. Michael Kelly, who specializes in paternity cases in Los Angeles.

"One thing that a judge takes incredibly seriously when children are involved is pornography," Kelly says. "The judge will look at the larger moral character of both parents, but I do not think Janine Lindemulder has a chance at gaining full custody of Sunny James."

Kelly says if Lindemulder is able to obtain custody, James' child support payments would go "through the roof," possibly enabling Lindemulder to be unemployed. "The judge will choose who will be the best fit for guardianship in the best interest of the child. Janine would need clear and convincing evidence that her lifestyle would be a better fit for Sonny."

Sandra Bullock's future involvement with James' three children remains unclear, Kelly says, adding that he assumes she and James had a prenuptial agreement of some sort.

Kelly also took a stab at analyzing James' philandering. "Jesse James is a tragic person," he says. "When anyone achieves success beyond what they think they should, deep down they feel they have a duty to sabotage themselves. That's Jesse. This was an act of self-sabotage. It's impossible to assume any confidences will be kept when a celebrity engages in sexual relations with a normal person. Automatically that person has the opportunity to gain money and visibility, and the tables have shifted."

Michelle McGee has faced similar custody turbulence in the wake of the scandal.

What ever happened to for BETTER or for WORSE????? They need to work this out between the two of them. Divorce is a very big step.This can be fixed and should in private BETWEEN THE TWO OF THEM not for the public to vote on. Lets all check out whats going on with all these women and men who think they can inject themselves into someone elses marriage.I have never heard DO YOU...TAKE ....AND THIS OTHER PERSON ALSO TO BE YOUR LAWFULLY WEDDED .... Think about it. Are the wrong people being trashed? I'm just saying!

Janine should get full custody. She should get FULL custody because she is red hot. This has nothing to do with what kind of a mother she is going to be. This is about Janine getting full parental rights based on her hotness.

This should go to the Supreme Court. All hot people should have their rights respected and protected. Then the city that she lives in should have to donate tax dollars to build Janine a solid gold brick castle to live in.

As a side note on the day of her winning court date the porno industry should sell all of Janines movies at 30% off.

What is the big deal, it is only sex. Just do not bring home a disease. Don't these people make a deal on what is allowed with other people? Like: you can do anything you want as long as you keep your pants on. This allows things like lap dances.
