Jon Gosselin Sues 'Absentee' Kate for Custody of Kids

Jon Gosselin has officially filed the legal papers in Pennsylvania to challenge Kate Gosselin for primary custody of their eight children, TMZ is reporting.

In the court papers, Jon alleges that Kate abuses the custody scheduling laid out through the arbitration process and claims she is not being completely honest about her income.

Gosselin's lawyer, Anthony F. List, argued this week that due to her involvement with 'Dancing With the Stars,' Kate has morphed into an "absentee mom." List adds that her commitments to the show keep her from spending "quality time" with their twins and sextuplets.

The attorney also hopes to reverse the child support payments that Jon has been making to Kate. Currently, he must pay $20,000 a month.

Kate, herself, was quick to shoot back upon hearing of the planned legal move. "I am not willing to comment in public on the custody discussions regarding my children. What I will say is this: I am and always will be a mother first, but as a single working mom, I will do everything necessary to provide for my kids despite the opinions of others," she told PEOPLE in a new statement.

Jon should not get the kids and eight should Kate as she is making a fool of herself. Give the kids to grandparents and get them all out of these two people lives They are both hurting them. I had to raise my grandson because both parents are not good parenting skills

Normally I think having the grandparents in the kids life would be a great idea. Got to remember on the show Kate never talked about her parents and after awhile would not have anything to do with her own brother and his wife who the kids loved. Many people from the church Kate's father is Pastor of have said she threw a fit when they all got cribs and clothes for the kids that didn't meet Kate's approval. On the only show I saw with Jon's family Kate ignored them all. Jon's old boss said when his Dad was alive he would take Kate food while she was expecting and one day she stormed into Jon's office because his Dad was later with her meal. You reap what you sow.

wonder what the grandparents are like. i don't see why jon can't work in show biz if no talent kate does. why should he be homeless and only allowed to see the kids when she says so? his NY lawyers did a lousy job in representing him. hope his new lawyer, Mr. List from Pennsylvania can get a fairer deal for him. if he's not a celeb and should get a regular job, why did Showbiz Tonight name his "most provocative celebrity of the week" last Friday?

These two parental train wrecks should get OFF television. These fertility doctor's who knowingly deposit upwards of 10 or more embryo's should have their licenses revoked permanently for irresponsible medical practice. I don't care what they 'believe', if you're not financially secure enough to raise that many kids without the benefit of whoring your entire family out to reality TV for the rest of your life, you should not HAVE them! Period!

wait. she gets 20,000 a month and she NEEDS to be on dancing with the stars? Bull. If I were Jon I wouldn't pay that amount either unless I knew that it was going towards the kids and the house. Seems from what we see, much of the fortune is spent by Kate on Kate. They are both lousy parents. They act like they are in high school. Kate is on TV because that is exactly where she wants to be. Does anyone really believe that she rather be at home doting on her 8 children? I think not. She's frustrated with the situation because she doesn't have her puppet Jon around anymore to do all the dirty work.
