E*Trade Slams Lindsay Lohan in Court Papers

Remember the $100 million lawsuit Lindsay Lohan filed against online financial firm E*Trade -- the one where she alleged an ad by the company, which featured a "milkaholic" baby girl named Lindsay, was modeled after her because she has the same single-name recognition as Madonna or Oprah?

Well, E*Trade sure does, and now they have filed papers slamming the actress in a duel attempt to either have the case dismissed or moved to a Manhattan court.

Lawyers for the financial firm have filed hundred of pages of documents, including details of Lohan's multiple arrests on DUI and drug charges as well as mountains of Internet commentary from her detractors, in an effort to see the case thrown out or moved from Long Island -- where Lohan filed the suit -- to Manhattan, where E*Trade's corporate headquarters are. The clippings are meant to show that Lohan is actually a resident of California and does not reside principally on Long Island.

The vitriol in the user-generated comments is particularly harsh, with the New York Post quoting one as saying, "[Lohan is] a pot-stirring, lazy, irresponsible, disrespectful little drama queen," while another reads, "She is the classic child star. A little success (parents pushed her into the business) at a young age and then she thinks she's the poo." Many of the comments are laced with profanity and discuss Lohan's past troubles with the law at length.

Despite its decision to use the Internet commentary as evidence in its case, E*Trade insists it is not arguing that Lohan has already defamed herself more than its commercial possibly could have.

Indeed, Dina Lohan believes the company's choice to use the commentary as part of its case will work in Lindsay's favor. "This is the whole reason we are suing them -- for demeaning Lindsay," Dina told the Post. "They are just proving how they operate -- they play dirty."

Stephanie Ovadia, Lohan's lawyer, has vowed to fight the motions to dismiss and change the venue.

Geeze! Talk about people looking to sue to make a buck! This mom is going to ride her daughters coat tails right straight to hell! If Lindsey doesn't do it first. I hope these people sue her for everything she thinks she is worth. Maybe then she will go away!

BTDT's point is what the real story is about and if I may say, his point needs more dialog. I'm not sure I’d call it “advice” or counsel that she received, but that ceratinly sounds politically correct.

SOME plaintiff attorney's should be monetarily fined or punished for filing such frivolous lawsuits; especially this one. They’re not giving counsel but rather taking advantage of a very vulnerable individual, and we all know it! Why do we as a society clearly allow the law to be used in this way when it’s just downright unethical. It's everything we are taught when we're young is wrong.

Anyway, your point summed up the story very well, I just had to call it what it is.

How can anything demean Lindsay Lohan any more than she has already done to herself? This is just a way for a washed up "almost" star to make drinking money since she won't work. It is a shame - she has talent but only uses it to party.

I LOVED Lindsay Lohan in "Parent Trap". That was sooo well done...she was amazing!! Geesshhh...did she do anything after that except feed the paparazzo? Too bad...what a waste of tallent!!
