'American Pie' actor Chris Klein could find himself facing a mandatory sentence of 4 days in jail if he's found guilty of his second DUI offense, PEOPLE reports.

Klein was arrested on June 16 around 3 a.m. after he was seen driving erratically. His blood alcohol was found to be nearly three times the legal limit, the authorities said.

The actor is charged with two offenses: driving under the influence with a prior conviction and driving with a .08 blood alcohol level or higher. Klein's previous conviction was in 2005.

Due to a new California law for repeat DUI offenders, Klein might have to do a breath check for alcohol in his system each time he wants to drive his car. The California Highway Patrol spokesman Leland Tang confirmed, "If he wants his license back, Klein will have to get an interlock device installed in his car and blow into it every time he wants to start the engine."
