Jesse James Wins Physical Custody of Daughter Sunny, Can Move Her to Texas

After an emotional custody battle, an Orange County judge ruled that Jesse James will get physical custody of daughter, Sunny, 6, and can move her to Texas to be closer to Sandra Bullock, UsWeekly reports.

Judge Thomas Schulte ruled that Sunny's mom, Janine Lindemulder, will share legal custody; she'll see Sunny once a month in California, half of the Thanksgiving and Christmas holidays, two-thirds of summer vacation and all of spring break.

Lindemulder, who was just recently released from a halfway house, broke down when the judge revealed his ruling. "I can't do this!" she said, while putting her head down. "I'll move! I'll move!"

Sunny will stay with Lindemulder for the rest of the summer and then move to Texas in time for the new school year.

Judge Schulte said his decision was based on several things: Sunny's bond with her older siblings that reside with James and how well she was doing currently in her father's care. The judge also noted that he felt Lindemulder was in a "fragile position to make poor decisions." He didn't mention Sunny's relationship with Bullock's adopted son, Louis, though Lindemulder did mention that Sunny misses him.

Once court adjourned, James immediately left on his motorcycle. Lindemulder stopped and spoke to the press, saying, "[Sunny] will be fine. It hurts. Sandy is good. Jesse is good. Sunny loves baby Louis. She's excited to move to Texas. [Bullock] will be good for her."

Sounds like Jesse and Sandra are in some kind of relationship thing, whether it's for the kids sake and they are friends or putting up with each other. The judge made a wise decision, but it is sure to break a few hearts, as custody issues always do. Looks like the story is over and life continues. Jesse is a good father, but not always a good husband.

Yeah good for the kids but once trust is gone, it is nearly impossible to get back. I'm sure Sandra does love those kids but anything other than that would be nuts.

I think that's what Jesse is trying to make it seem that way, but Sandra is in New Orleans. I really don't think she's going to keep the doors open to put Sandy in that type of situation. That's all Jesse wants, so he can ease his way back in. He's a dog and I know he's trying to manipulate the situation by using his daughter! I hate people that do that! Use children or anyone for their benefit!

Lindemulder better watch her p's and q's and not play games cause Sandra don't play that sh*t. Hopefully, mother and father can put aside their differences and raise their daughter with other caring and loving people....like Sandra. Sandra is divorcing Jesse, not his child. She is mature and secure enough emotionally to handle anything or anyone that gets in her way.

it's a sad state of the "justice" system and child advocacy when the rights of a star supercede those of a child's mother!

Sandra should never have been mentioned in this custody hearing; she has NOTHING TO DO WITH IT! She and Jesse are divorced and, regardless of whatever the hell HE WANTS, Sandra has nothing to do with this decision... meanwhile, the CHILD'S MOTHER wasn't given half that consideration!

Sounds like YOUR the chauvinist here,(correct spelling) and you obviously read something in the essay that simply isn't there. I know nothing of these people, and even I can see the judge didn't regard Bullock at all. Period.

Agree...and Bullock is probaly footing the bills. Flying the kid back and forth. Who is paying the drug addict mom or the dad. Bullock is probaly only in this to pay the bills. She should cut the ties and get away while she can. Look for this kid in a few years.

I didn't know she was a junkie. Please excuse my ignorance. Man, some people can be so mean. This is the only article that I have read on this subject. As a mother myself, I could not ever imagine this. I live for my son.

I think this judge is a jerk. Taking a child from her mother. That is just unnatural. I hope she does move to texas to be closer to her daughter, and I hope that he is man enough to open up the custody arrangement more than what the judge awarded. This is enough to drive a mother over the edge. We live for our children, we breath for them, everything we do is for our children. I am not saying the same isn't true for men, it is. But, A child needs it's mother. That is why we give birth to them, and not the father.

kara no one took her "away" from her mother. She hasn't been a mother to her in a long time...The judge made a good decision. He may be a lousy spouse but he is a good father.

If Lindemulder "lived for her child" as you claim, then she wouldn't have been in prison or shacking up with convicts, or doing drugs, or any of the other things she's done, and she would have been raising her daughter all this time, instead of putting her own selfish desires ahead of her child. The judge made a good decision. It isn't about what's best for the mother, it;s about what's best for the child. And clearly, living full-time with her mother was NOT in Sunny's best interest. Jesse may be a douche of a husband, but he is clearly the better parent.

Kara - you do realize Jesse has had full custody of his daughter since she was one year old because the mother was in jail the entire time. This child is now 6. So to say it is wrong to take the child from her mother is an asnine statement since her mother has never had custody of her daughter.

Kara, what a ridiculous post. Do you honestly think that just because a woman gives birth it makes her a great parent? She's a junkie, stupid. He may suck as a husband, but clearly is the more stable parent of the two. You know what's "unnatural"? A woman like this gives birth to a gorgeous baby girl and then, instead of mothering her, decides to spend her time getting high. That's just "unnatural".
