Judge Denies Bail, Takes Lindsay Lohan Into Custody
Lindsay Lohan was denied bail and taken into custody Friday after breaking probation by failing a pair of drug tests following her release from rehab. Judge Elden Fox
reportedly issued the order without hearing arguments from Lohan's lawyers, and now the perpetually-troubled actress could be held in custody until a hearing in late October.
The 'Mean Girls' star rolled up to the Beverly Hills courthouse wearing a black top, white skirt and a confident smile. It was her first appearance before Judge Fox, who issued an arrest warrant earlier in the week to compel Lohan to appear. He previously outlined that he would sentence the actress to a month in jail if she failed a drug test. However, it was believed that unless Lohan requested immediate sentencing, the judge would set bail and release her until a formal probation revocation hearing.
But it became clear that things were not going to go smooth for Lohan when her attorney, Shawn Chapman Holley, asked Judge Fox whether the star's probation revocation hearing could be delayed a week.
"I think your client would rather have it on Oct. 22," Fox said, prompting Holley to rise and argue that bail should be set then and now. "Nope," Fox replied, tersely. The message was clear: she was going to spend a month in jail.
The shocked actress was soon in handcuffs and taken into custody before being transported to Century Regional Detention Center in Lynwood.
The star's estranged father, Michael, spoke briefly following the hearing, saying the judge's decision was a "wake-up call" and that he was going to "pray" for his daughter's recovery. At the same time, he didn't seem to fault Judge Fox for the decision.
"The judge has to do what the judge has to do," he said.

The 24-year-old 'Machete' star
took to Twitter on Sept. 18 and admitted that she "did in fact fail my most recent drug test" and that she was "prepared to appear before Judge Fox next week as a result."
According to the terms of Lohan's probation, a failed drug test means she will spend another 30 days in jail. Two tests came up positive for cocaine and illegal Adderall use.
In other tweets from the actress, she added, "Substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it and am taking positive steps ... forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future."
Lohan was released from court-ordered rehab at UCLA Medical Center on Aug. 24 after only 22 days. Judge Marsha Revel sentenced Lohan to 90 days in jail and a 90-day inpatient rehabilitation program on July 6 for violating her probation in a 2007 DUI case. She ended up serving only 14 days due to good behavior and overcrowding at the jail.
According to sources close to the case, doctors overseeing the actress at UCLA saw no cause to keep her in rehab for the entirety of the 90 days she was sentenced to by Judge Revel, who has since recused herself from further proceedings related to Lohan.
Her legal woes began in May 2007 when she was arrested following a minor car accident and charged with DUI. Just two months later, she was taken into custody for suspicion of drunk driving and cocaine possession.
Following her first DUI, Lohan spent 84 minutes in jail after pleading guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.

She makes me sick.

She's an idiot. Maybe if she actually served her full sentence she would've thought twice about abusing again. Anyone who goes to court with "f.u." painted on her fingernails doesn't deserve to get out for good behavior. If she weren't a star, she would've never gotten away with violating probation with a shorter sentence. Throw the book at her. It's the only way to keep her from killing herself.

Would be even better if she was put in with the general public, not an isolated cell.
VERY GOOD MOVE! IF SHE BROKE THE LAW....LET HER SPEND TIME IN JAIL. I JUST HOPE SHE DON'T GET SPECIAL TREATMENT LIKE SHE DID LAST TIME!
Reply
She whould do much more than 30 days for breaking the terms of her probation! She doesn't take the court system seriously and I think this time she should be taught a lesson.
I don't like special treatment for celebrities either but sometimes you have to do it. Reports say there are already women in prison waiting to violate her. They do the same for police officers on prison.
What happened to over-crowding?
Reply
what does over crowding have to do with it? Let her share a cell with some relly bad people. She might learn something.
Let her double up with BABA's sister [BIG BERTHA] and all her frends for the next 30 days.
The doctors at rehab who decided she didn't need to be there need to have their heads examined because CLEARLY she DOES need to be there...what a bunch of quacks
Reply
She probably gave them a little sumpin-sumpin so they would say she was fine. She is a hottie, after all. Yeah, she has no brain, but still...thinking those doctors are above some form of payoff is dumb.
And, let's not forget that she is an (actress). The judge did the right thing by taking her into custody until the late October court date. At that hearing she will face the consequences of her probation violation. Her contempt for the legal system is why she felt secure that failing the drug/alcohol tests was no big deal. Until the rehab and judges keep her for the maximum sentences instead of this early off crap, Ms. Lohan will continue to break the rules. Unfortunately, many of our young adults were raised to object to authority of any kind. It amazes me to hear people my age who went through the 60's era of rebellion STILL say "I don't like authority", ie: police.
I wldn't be so quick to blame the doctors.. maybe she's not an addict, and perhaps just an idiot. Doctors fix sick people.. and there's no cure for stupid.
If this were Arizona , and this being her third or more offense she would be doing life in prison where she would no longer be a threat to society. In fact in Arizona she could user her own money to build her own "Private Prison" to spend the rest of her life and as it would be a "Private Prison" she could make it for strictly Multi-ofending Celebs.
Just curious. Do inmates have to pay for their incarceration, since taxpayers are footing the bill for their room and board and all of the other expenses that go along with running a prison?
Reply
Nope. Tax payers pay for jail stints. I think she she be ordered to spend her millions building a drug rehab center!!!Instead of sending first time drug offenders to jail, send them to rehab for a month. If they do drugs AGAIN, throw them in jail.
In Arizona those sent to jail for DUIS have to pay for jail, unless they absolutely have no money. The dui law in AZ is 10days in jail for first offense,6 months driver,s license suspended,1 year of a breathalizer in your car
FINALLY a Judge that has some guts to stand up for the Law. I think that Lindsay should stay in jail, and that the Judge should have added more time to the 30 days for CONTEMPT of Court, for Violating a Court Order of NOT USING ALCOHOL AND/OR Drugs. When She goes back to Court for another Hearing, I think that the Judge should Uphold the Law, and make her do the Original Sentence of 2 years, following that By IMMEDIATELY after her release form jail into a 6 month IN HOUSE Treatment Facility
Reply
YES, YES, YES,....AT THE VERY LEAST!!!!
Oh but poor, poor Lindsay, she has an illness according to her. Don't you just feel so sorry for her? I mean do people think she should have to stay at home and not go party? I mean after all she IS Lindsay Lohan! Hahahaha, I hope she is locked up for at least 6months, then rehab for 6months, then in house arrest for 6months, all of this while wearing a monitor and drug testing everyday being alcohol leaves the system pretty quick. The monitor and drug testing continue for the next 5years. I still remember hearing her just a few weeks ago saying "I want my career back!" She said it with an attitude like she is entitled. I guess she doesn't know she isn't that good looking and is easily replaced.
