Judge Denies Bail, Takes Lindsay Lohan Into Custody

reportedly issued the order without hearing arguments from Lohan's lawyers, and now the perpetually-troubled actress could be held in custody until a hearing in late October.
The 'Mean Girls' star rolled up to the Beverly Hills courthouse wearing a black top, white skirt and a confident smile. It was her first appearance before Judge Fox, who issued an arrest warrant earlier in the week to compel Lohan to appear. He previously outlined that he would sentence the actress to a month in jail if she failed a drug test. However, it was believed that unless Lohan requested immediate sentencing, the judge would set bail and release her until a formal probation revocation hearing.
But it became clear that things were not going to go smooth for Lohan when her attorney, Shawn Chapman Holley, asked Judge Fox whether the star's probation revocation hearing could be delayed a week.
"I think your client would rather have it on Oct. 22," Fox said, prompting Holley to rise and argue that bail should be set then and now. "Nope," Fox replied, tersely. The message was clear: she was going to spend a month in jail.
The shocked actress was soon in handcuffs and taken into custody before being transported to Century Regional Detention Center in Lynwood.
The star's estranged father, Michael, spoke briefly following the hearing, saying the judge's decision was a "wake-up call" and that he was going to "pray" for his daughter's recovery. At the same time, he didn't seem to fault Judge Fox for the decision.
"The judge has to do what the judge has to do," he said.

The 24-year-old 'Machete' star
took to Twitter on Sept. 18 and admitted that she "did in fact fail my most recent drug test" and that she was "prepared to appear before Judge Fox next week as a result."
According to the terms of Lohan's probation, a failed drug test means she will spend another 30 days in jail. Two tests came up positive for cocaine and illegal Adderall use.
In other tweets from the actress, she added, "Substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it and am taking positive steps ... forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future."
Lohan was released from court-ordered rehab at UCLA Medical Center on Aug. 24 after only 22 days. Judge Marsha Revel sentenced Lohan to 90 days in jail and a 90-day inpatient rehabilitation program on July 6 for violating her probation in a 2007 DUI case. She ended up serving only 14 days due to good behavior and overcrowding at the jail.
According to sources close to the case, doctors overseeing the actress at UCLA saw no cause to keep her in rehab for the entirety of the 90 days she was sentenced to by Judge Revel, who has since recused herself from further proceedings related to Lohan.
Her legal woes began in May 2007 when she was arrested following a minor car accident and charged with DUI. Just two months later, she was taken into custody for suspicion of drunk driving and cocaine possession.
Following her first DUI, Lohan spent 84 minutes in jail after pleading guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.

She expected bail and a hearing, but was surprised to be led away in handcuffs, no bail. GR8! Time she stopped getting special treatment. The law should apply equally to all. She has been given enough breaks. There is a dead Angles pitcher whose killer got one break to many.

This story said lindsay might have to spend another 30 days in jail. Like we all forgot she was in there for a few days, due to over crowding.
It will be interesting to see how many days she spends in jail this time.
And I know the girl is in her own cell, no one can convince me other wise.

Finally someone going to stand up and make a stand for our youth today. These kids idolize these celebrities and think there actions will follow the same consequences and us parents are the ones picking up the brunt of the screw ups. Good job Judge, keep her there and set a example with her of TAKING OWNERSHIP and PUNISHMENT for breaking the LAW!!!!

Gosh maybe since it took her no time at all to find drugs once she was out, maybe she should help Bin Laden after the Bush administration let him run and hide. Or maybe find those mysterious WMD's.

This is a total injustice...If she was driving under the influence, that's a different story, One should be arrested for failing a drug test...If that was the case ? Millions of people should be in jail...How many of your kids are getting drunk on weekends...How many are taking drugs that you don't know about...Maybe when one of your kids dies of an overdose you might stop and think about how you so quickly condemned other people...

It's not injustice. She was let out on probation (that means early release from a criminal conviction) and told to abide by certain rules, one of those to be no alcohol or drugs. She didn't do that. Therefore....it is justified that she be arrested AGAIN. She's not innocent.
She violated the conditions of her probation which is a crime.
I personaily don't do any drugs or drink for fear of what my mother would do to me. I love my mother and she has done everything she could for me and the first time I tried a cigerate at 13 I got a butt beating so hard I couldn't sit that evening I thank her every day for that now
Chaz, you seem to not understand the conditions of her release. She was ORDERED NOT to use DRUGS/ALCOHOL in any form. That she would be tested randomly and if she failed, she faced going back to jail! She didn't need to be driving, all she had to do was have drugs/alcohol in her system. She VIOLATED her terms or probation, so she goes to jail for same.
I had a 31 year old daughter die of an accidental overdose. There were never drugs in our home and coffee was the drink offered....Get this one straight now and she won't A.go broke paying attorneys, B.kill herself or some one else and C.get a life.
Finally a righteous judge...if you do the crime, serve the time.

Great! Maybe someday she will learn that the law applies to all and that she is no exception. I hope she is sentenced at the next hearing to jail until Jan. 1 and then see if she can the new year on the right path.

This idiot can afford the rehab. Keep her there for 90 days. Inpatient. Not like we need the taxpayers picking up more of her special treatment for prison. She's a loser, not anything else. She doesn't have to stay sober because she knows she won't face any real penalty. So far, that's been the case for all so-called stars who've flaunt the law.

This girl is in deep trouble and is enabled by family, friends and apparently even the medical field. For Doctors to turn her out of rehab to outpatient care was insanity. She needs intensive, months long, in house treatment for the killer disease of addiction.The judge rocks! A man with both brains and balls.
