Judge Denies Bail, Takes Lindsay Lohan Into Custody
Lindsay Lohan was denied bail and taken into custody Friday after breaking probation by failing a pair of drug tests following her release from rehab. Judge Elden Fox
reportedly issued the order without hearing arguments from Lohan's lawyers, and now the perpetually-troubled actress could be held in custody until a hearing in late October.
The 'Mean Girls' star rolled up to the Beverly Hills courthouse wearing a black top, white skirt and a confident smile. It was her first appearance before Judge Fox, who issued an arrest warrant earlier in the week to compel Lohan to appear. He previously outlined that he would sentence the actress to a month in jail if she failed a drug test. However, it was believed that unless Lohan requested immediate sentencing, the judge would set bail and release her until a formal probation revocation hearing.
But it became clear that things were not going to go smooth for Lohan when her attorney, Shawn Chapman Holley, asked Judge Fox whether the star's probation revocation hearing could be delayed a week.
"I think your client would rather have it on Oct. 22," Fox said, prompting Holley to rise and argue that bail should be set then and now. "Nope," Fox replied, tersely. The message was clear: she was going to spend a month in jail.
The shocked actress was soon in handcuffs and taken into custody before being transported to Century Regional Detention Center in Lynwood.
The star's estranged father, Michael, spoke briefly following the hearing, saying the judge's decision was a "wake-up call" and that he was going to "pray" for his daughter's recovery. At the same time, he didn't seem to fault Judge Fox for the decision.
"The judge has to do what the judge has to do," he said.

The 24-year-old 'Machete' star
took to Twitter on Sept. 18 and admitted that she "did in fact fail my most recent drug test" and that she was "prepared to appear before Judge Fox next week as a result."
According to the terms of Lohan's probation, a failed drug test means she will spend another 30 days in jail. Two tests came up positive for cocaine and illegal Adderall use.
In other tweets from the actress, she added, "Substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it and am taking positive steps ... forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future."
Lohan was released from court-ordered rehab at UCLA Medical Center on Aug. 24 after only 22 days. Judge Marsha Revel sentenced Lohan to 90 days in jail and a 90-day inpatient rehabilitation program on July 6 for violating her probation in a 2007 DUI case. She ended up serving only 14 days due to good behavior and overcrowding at the jail.
According to sources close to the case, doctors overseeing the actress at UCLA saw no cause to keep her in rehab for the entirety of the 90 days she was sentenced to by Judge Revel, who has since recused herself from further proceedings related to Lohan.
Her legal woes began in May 2007 when she was arrested following a minor car accident and charged with DUI. Just two months later, she was taken into custody for suspicion of drunk driving and cocaine possession.
Following her first DUI, Lohan spent 84 minutes in jail after pleading guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.

Todd,
Substance abuse turns into addiction. Addiction, can then, turn into a disease. F.Y.I.
This is a total injustice...If she was driving under the influence, that's a different story, One should be arrested for failing a drug test...If that was the case ? Millions of people should be in jail...How many of your kids are getting drunk on weekends...How many are taking drugs that you don't know about...Maybe when one of your kids dies of an overdose you might stop and think about how you so quickly condemned other people...
Reply
MINE DONT!
she was on Probation with a note that if she failed a test this would happen. Where is the injustice????
I don't have any kids and if I did and they were doing drugs or driving while drunk I would throw their butts in jail myself !!!
Lets see if they get it right this time full sentence none of this BS about the jail is to full make Room!!!!!!!!!!!!!!!!!
Reply
she will go to jail again, get out early again, go to reb-hab again and get early again and so it goes on and and on again.
I am so sick of these so-called stars getting away with this crap.
Reply
Well lets see how her mother spins the failed drug test to NOT BE Lindsay's fault......somebody else made her do it!
Reply
I think the new judge is a dude, dude.
Reply
If that is the case with this stupid fugly broad, the everybody who gets arrested with drugs on them should get probation or re-hab.. like lil Wayne, DMX and other rappers and black guys who have been arrested...what makes this skank her and that goofy looking Paris Hilton so special??? very un-fair and then folks wonder why other people always want to do something t0 Americans.. its a double standard here especially for blacks...????????????????????????????????????????????????
Reply
REALLY!? Americans should wonder why..OTHER PEOPLE..(terrorists??)want to do something to the U.S.A.??!!Do you have an answer for what we did to them? Like on 9-11?DO YOU actually think it was because Lindsay, or Paris got pet jail sentencing?
Or because some rapper got put in jail for weapons, and drugs?
Kim, do you even know how many "black" as you quoted them, people
died in the Twin Towers on 9-11.Do you even know??!! If you can pull a racist card on terrorism, and can see justice for them,
"OTHER PEOPLE", Get off U.S.A. soil! They`ll love you!!!
Hey put her in with the general population. Maybe that will teach her a leason or two. None of this special treatment.
Or maybe California should build a jail for the stars.
Reply
Apparently we already have them in California. Put her in the cell with her buddy Paris!
A JAIL FOR STARS IS FUNNY! LOL
SOME SMUCK WILL MOST LIKELY DO THAT, BECAUSE MY TAXES SURE AS HELL WILL NOT PAY FOR IT. I LIVE IN SOUTHERN CALIFORNIA AND THE STAR TREATMENT IS UNREAL!
THANKS 4 THE LOL! GOOD 1
Another tap (not slap) on the wrist for this chronic junkie. If you or I violated probation (should be parole) we would do 10 years!
Kudos to the judge!

It may save a life. Either her or someone else's.

So she spent 12/90 days at her last sentencing. If she gets another 30 sentenced, that means another 4 days for her...maybe. Her legal team will likely cut that down to a single day. Whatever.

Something tells me that this judge will be no nonsense. I would have loved to have seen the expression on her face. SURPRISE! She seemed so confident going in thinking this was JUST 'another' day in court, JUST 'another' small annoyance in her stellar life...
Let's face it: Lindsey Lohan will NEVER stop using until the final fatal OD.
I'm just wondering who her greedy parents will sue for "wrongful death" after that happens.

so.........why isn't paris hilton in jail?
