That's not the point. The point is we have a Constitution that specifically gives them this right. End of story.

If we start making our own rules and inciting fear over ignorance, then why use the Constitution at all...if you are going to pick and choose from it when it suits your purpose.

This is the problem I see with the Tea Party movement. They essentially want to move back to the Articles of Confederation. The AOC didn't work well and that's why the Declaration was adopted. States rights cannot superceede the government.
