Jaime Pressly might have had a blood alcohol level that was more than three times the legal limit in California, but that doesn't mean the actress is admitting to driving under the influence.

The former 'My Name is Earl' star is pleading not guilty to drunken driving charges resulting from her Jan. 5 arrest. The 33-year-old was stopped for a traffic violation while driving in Santa Monica around 11PM. She then failed a field sobriety test and registered a BAC of 0.22. Pressly was later released from jail after posting $15,000 bail.

Later on in January, she filed for divorce from Simran Singh, her husband of 16 months. Shortly thereafter, a custody battle with her former-fiance DJ Eric Cubiche began to heat up. The two have a 3-year-old son named Dezi. Cubiche's mother said "Jaime and Eric have always had a nice relationship when it comes to my grandson Dezi, but that could change. My son remains focused on Dezi. We're very protective of (him) and want nothing but the best for that precious boy."

Court records show that Pressly was ordered by a judge to attend Alcoholics Anonymous meetings at least twice a week. But despite that order and a formal DUI charge earlier this week, the actress was still slated to headline for two night club events in Vegas.
