Gabriel Aubry Dismisses Halle Berry Custody Case [Updated]

Halle Berry's ex-boyfriend Gabriel Aubry has filed to end his custody case for 2-year-old daughter Nahla, RadarOnline.com reports. The site confirmed that Berry and her lawyer were sorting out the development in court Wednesday afternoon.

The couple have been at the center of tabloids lately, going from amicably split to vocally embattled. Reports came in this morning that Berry and Aubry were considering setting aside their differences for their daughter and that they'd begun talking again.

"Halle Berry's breakup with Gabriel Aubrey and custody dispute over their daughter has been one of the strangest, most perplexing cases in recent memory," RadarOnline founder and executive vice president David Perel tells PopEater. "They went from seeming to get along fine to a bitter dispute that looked like only a judge could solve it. And just as everyone thought it would have to be fought out in a courtroom, the situation changed again, and Aubrey filed a motion to dismiss his own case."

4:50PM update: Radar tells PopEater Berry has left court. "Halle won a procedural hearing to take Nahla across the country to New York," David Perel tells us. "Gabriel has withdrawn his suit as the paperwork shows. He has not filed anything new. Despite reports he is filing a different suit, that has not happened yet. We will know more about what he plans to do shortly."

Aubry, 34, filed for joint custody on Dec. 30, kicking off a tabloid war between himself and Berry, 44. The two dated for five years before splitting earlier in April 2010.

"I think both sides realized how out of hand things had gotten recently," an insider tells Radar. "They both love their daughter and want to make sure her welfare comes first. Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts -- Gabe's decision to drop his case is his way of showing Halle he's prepared to take a leap of faith and trust her once again."

Before this development about Aubry dropping the custody case, a source close to the couple told Radar: "Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up 'til now. Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter."

I smell a monetary settlement. I guess he got what he wanted. If you ask me Halle has terrible taste in men. She needs to stay single for a while. But it sounds to me like she is one of those needy women that needs a man to validate who she is.

Suddenly Halle does not have "fearful concerns" when her daughter is with her father. This has nothing to do with money- just a control freak who wanted a child and thinks the dad has no importance or rights.

You have no idea what Aubry is like behind the scenes. If he is hooking up with Kim Kardashian, then I think his character is to be seriously questioned. I would not want my daughter around Kardashian or her entire family. Kim will lie down with absolutely anyone she thinks will bring her notoriety and money. Her entire self is for sale, and I wouldn't want my daughter learning that. As for rants, emails, messages, etc., most people aren't themselves when they have a breakup and often do/say things that don't reflect well on themselves in front of people who don't know the whole behind the scenes aspect of the relationship that is ended. HE withdrew paperwork and I would be willing to bet it's either because she paid him off or he discovered she had something damaging on him. Either way, he didn't call it off for a good reason and anyone who thinks he is blameless has never been in a relationship.
