Gabriel Aubry Dismisses Halle Berry Custody Case [Updated]

Halle Berry's ex-boyfriend Gabriel Aubry has filed to end his custody case for 2-year-old daughter Nahla, RadarOnline.com reports. The site confirmed that Berry and her lawyer were sorting out the development in court Wednesday afternoon.

The couple have been at the center of tabloids lately, going from amicably split to vocally embattled. Reports came in this morning that Berry and Aubry were considering setting aside their differences for their daughter and that they'd begun talking again.

"Halle Berry's breakup with Gabriel Aubrey and custody dispute over their daughter has been one of the strangest, most perplexing cases in recent memory," RadarOnline founder and executive vice president David Perel tells PopEater. "They went from seeming to get along fine to a bitter dispute that looked like only a judge could solve it. And just as everyone thought it would have to be fought out in a courtroom, the situation changed again, and Aubrey filed a motion to dismiss his own case."

4:50PM update: Radar tells PopEater Berry has left court. "Halle won a procedural hearing to take Nahla across the country to New York," David Perel tells us. "Gabriel has withdrawn his suit as the paperwork shows. He has not filed anything new. Despite reports he is filing a different suit, that has not happened yet. We will know more about what he plans to do shortly."

Aubry, 34, filed for joint custody on Dec. 30, kicking off a tabloid war between himself and Berry, 44. The two dated for five years before splitting earlier in April 2010.

"I think both sides realized how out of hand things had gotten recently," an insider tells Radar. "They both love their daughter and want to make sure her welfare comes first. Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts -- Gabe's decision to drop his case is his way of showing Halle he's prepared to take a leap of faith and trust her once again."

Before this development about Aubry dropping the custody case, a source close to the couple told Radar: "Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up 'til now. Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter."

This pic shows how little regard Gabriel has for Nahla. He is carrying the child like she's a sack of potatoes spilling out of the bag. A loving father HOLDS his child, not sulks and acts as if he wants nothing to do with her, other than the impending monetary settlement for his sperm donation...

Whatever happened to getting married and working things out for better or worse. People fall in and out of love like changing ice cream flavors. They should be barred from having children until they are in a partnership for at least 7 years. They will know the ends of out of one another by then and should be willing to work as a unit. The father deserves joint custody and that should be written into law unless one parent is a molester or spouse beater. Halle is 44 and old enough now to know how to hang onto a man. You cannot have your way all the time. Also, if you find the man is immature, then marry closer to your own age or older. These folks need to think of their children instead of self. Look around... we have future generations filled with unbalanced violent kids and spoiled brats because there has not been a healthy parental balance in American children's lives. This bode very poorly for America's future.

The man has made a lot money on his own. He still continues to make money. Just because Berry makes more doesn't make him automatically a golddigger. Gee how terrible a man who has impregnated a woman and had a five year relationship with her actually wants to co-parent the child? Horror. Yeah, what a terrible man he is. Men always get the short straw in custody hearings and it is played out on here because the conclusion is always that it is HIS parenting that is at fault instead of it's her using the kid as a pawn because he's moving on with his life and she wants to control his actions by withholding access to his child. Wow, now THAT's never happened in these types of proceedings, has it?

I wonder how much fatter his bank account is tonight? I think she might think twice before having a child with someone. People having feelings and I think she thought he was a boy toy and could just take the child and walk. I am glad that he wanted to see his child and did the right thing. I think she paid him off to ease up with the suit.

Halle Berry is a joke. Some men are equipped to put themselves second to a needy woman. Halle cannot keep the headlines on herself unless she is doing a movie and up for an Oscar, which she is not, or when she is having men troubles. She is a needy actress who is overrated and not holding the interest of people. I am not bashing her, I'm simply saying this relationship she had with Gabriel was one she created for the purpose of making herself feel good, and giving little regard to Gabriel or the baby. So what she has a new boyfriend? Why does she feel she has the right to not share custody withthe man she thought was good enough to father her child? She needs to grow up. She has one bad relationship after another, and I have to tell you, that should be a red flag to any man. Halle can't be the victim all the time. If she is, then maybe she needs to seek therapy and not worry about boyfriends.

What the h*ll is wrong with you people? Who the h*ll has any business about this other than the people involved, and frankly given what else is happening in the world, how pathetic do you have to be to spend your time reading about the marital issues of someone who is of no consequence whatsoever to anyone other than their immediate families? Of course life should not be deadly serious all the time and we should all bask from time to time in the joy of frivolous pursuits, but what on earth is frivolous about the family problems of two people most of us will never meet? Can we please recover just a little bit of perspective on what matters in any meaningful sense of the word?

its probably not halle & gabriel fighting like rabid dogs, but their lawyers. lawyers smell money and they provoke suits, the thicker the wallet-the longer the fight will last. they(lawyers)will say anything they can think of to make a legal fight last as long as possible-as long as the fight lasts-they keep receiving checks in the mail-pure manipulation.

To Lisa, I know you may not care for Halle or Gabriel and that's your right to say and feel but, to say "you don't give a damn what happens to an child" tells me "YOU DON'T GIVE A DAMN about yourself either." What a shame to feel as you do about an innocent child.

Halle picked him to be the father of her baby. Therefore, he is entitled to have visitation and a relationship with his daughter. How dare Halle think that being the mother entitles her more.
