Gabriel Aubry Dismisses Halle Berry Custody Case [Updated]

Halle Berry's ex-boyfriend Gabriel Aubry has filed to end his custody case for 2-year-old daughter Nahla, RadarOnline.com reports. The site confirmed that Berry and her lawyer were sorting out the development in court Wednesday afternoon.

The couple have been at the center of tabloids lately, going from amicably split to vocally embattled. Reports came in this morning that Berry and Aubry were considering setting aside their differences for their daughter and that they'd begun talking again.

"Halle Berry's breakup with Gabriel Aubrey and custody dispute over their daughter has been one of the strangest, most perplexing cases in recent memory," RadarOnline founder and executive vice president David Perel tells PopEater. "They went from seeming to get along fine to a bitter dispute that looked like only a judge could solve it. And just as everyone thought it would have to be fought out in a courtroom, the situation changed again, and Aubrey filed a motion to dismiss his own case."

4:50PM update: Radar tells PopEater Berry has left court. "Halle won a procedural hearing to take Nahla across the country to New York," David Perel tells us. "Gabriel has withdrawn his suit as the paperwork shows. He has not filed anything new. Despite reports he is filing a different suit, that has not happened yet. We will know more about what he plans to do shortly."

Aubry, 34, filed for joint custody on Dec. 30, kicking off a tabloid war between himself and Berry, 44. The two dated for five years before splitting earlier in April 2010.

"I think both sides realized how out of hand things had gotten recently," an insider tells Radar. "They both love their daughter and want to make sure her welfare comes first. Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts -- Gabe's decision to drop his case is his way of showing Halle he's prepared to take a leap of faith and trust her once again."

Before this development about Aubry dropping the custody case, a source close to the couple told Radar: "Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up 'til now. Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter."

Kim Kardashian stated she wanted to be called stepmom. Gabriel took his child around her even though he didn't know her well which shows poor parenting skills on his part. Later, Kim stated,"She wouldn't recognize Nahla if she wasn't in the presence of either Ms. Berry or Gabriel at the same time". Wow.

I know Halle. We had the same manager, in New York. I have, also, met her mother, who is a lovely and caring woman. Having said that, Halle has issues and I hope she deals with them before she creates more unhappiness, in her life and the life of her child. From the moment I met her I knew she would be a huge star but I knew, as well, that she needed help to deal with her emotional problems. Again, I hope she finds a good therapist who helps her work through her problems. Otherwise, she will never be happy and her little daughter will suffer.

Beautiful women have a hard time keeping a man, if you had her fame and money you would look good too, skin light, teeth redone everything false nothing real, there is more to her then meet the eye, if you really know her you may not like her. none of the stars were born a certain way they had the help of plastic surgeons, so that you may worship them. a man needs more then just a beautiful face wish the best for her and her family, sincerely.

Katie... You must read to many rag mags. You have no idea what Hally or Kim are like behind the scenes yet you dont mind judging Kim or Gabriel. Do you think Hally is any better the way she goes through men? Or that she is blameless? Look in the mirror before you judge others. The magazines will say any thing to sell. This is a personal issue and hopefully they can resolve it between them now. People who are rich and famous have the same problems as us. They also have the right to some privacy.

Berry she is overated and he like all the others, had her and left her. The beautiful child deserves more then parents fighting and making her the prize. They had a child, now they owe to her to give her a loving, peaceful life. Beauty doesnt deserve any of this.

The parents may not think the child is old enough to understand but with the internet she will grow up in the news. Past and present. Lawyers try to throw crap out into the world to make the other guy the bad guy. Judges watch the news too. I almost believe that divorce info should be fed into a machine. That way there is no right or wrong just 0's and 1's. Black and white. No, he said she said. Kids suffer every time. No lawyers to get rich off of other peoples misfortune. Halle Berry has NOT been winning in the court of public opinion lately.

She acted and sounded petty, racist, and nuts. I think she knew what had to happen in order not to damage her career any longer.

They stopped this just in time! I still believe he is the most stable. That's certainly obvious today.
