Gabriel Aubry Dismisses Halle Berry Custody Case [Updated]

Halle Berry's ex-boyfriend Gabriel Aubry has filed to end his custody case for 2-year-old daughter Nahla, RadarOnline.com reports. The site confirmed that Berry and her lawyer were sorting out the development in court Wednesday afternoon.

The couple have been at the center of tabloids lately, going from amicably split to vocally embattled. Reports came in this morning that Berry and Aubry were considering setting aside their differences for their daughter and that they'd begun talking again.

"Halle Berry's breakup with Gabriel Aubrey and custody dispute over their daughter has been one of the strangest, most perplexing cases in recent memory," RadarOnline founder and executive vice president David Perel tells PopEater. "They went from seeming to get along fine to a bitter dispute that looked like only a judge could solve it. And just as everyone thought it would have to be fought out in a courtroom, the situation changed again, and Aubrey filed a motion to dismiss his own case."

4:50PM update: Radar tells PopEater Berry has left court. "Halle won a procedural hearing to take Nahla across the country to New York," David Perel tells us. "Gabriel has withdrawn his suit as the paperwork shows. He has not filed anything new. Despite reports he is filing a different suit, that has not happened yet. We will know more about what he plans to do shortly."

Aubry, 34, filed for joint custody on Dec. 30, kicking off a tabloid war between himself and Berry, 44. The two dated for five years before splitting earlier in April 2010.

"I think both sides realized how out of hand things had gotten recently," an insider tells Radar. "They both love their daughter and want to make sure her welfare comes first. Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts -- Gabe's decision to drop his case is his way of showing Halle he's prepared to take a leap of faith and trust her once again."

Before this development about Aubry dropping the custody case, a source close to the couple told Radar: "Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up 'til now. Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter."

Well.. in this Monetary SETT... other blind situation always happen and none like to talk about. BUT any black and white
couple build in untrusth, jealosuy, diferent actions, lies btw always will be temporary season... like apple season.. if no change the birds, change the season, in this case change the fruits inset..

Censorship is real,Ha!

I guess mine were censored because I wrote of the horrendous pictures taken of her years ago after her "car accident".

The story is about a Man and Woman and their child ...Unlike the Tiger Woods case....I am so glad to read,(so far anyway),that a mixed marriage is NOT the problem....Hopefully they can get all of this straightened out ,...for the child

To be honest Nahla is only 1/4 black. Halle is biracial and Gabriel is white. Not that it matters. If Halle wanted a "black" child she should have been with a black man.

You think HIS character should be in question? How many people has he hit and then kept going? Her problem is she's met her match with a man who can fight her in court because he too has money and wasn't backing down from her. The courts should have her evaluated. And the racial remarks she's made since this all began??? The fact no one see's anything wrong with that is disturbing. Her true "colors" are definately showing now.

Yes she met someone who finally stood up to her, she stretched those claws, thought she's EVERYONE'S DARLING. Not! Everyone did not go for her evil stories. That child would be much better off with her dad, just like Anna Nichole Smith's baby.
Keep Halle off the talk shows. Sick of her, her designer clothes and boring "do". I refuse to watch that pampered twit's movies.
