Jail or Trial? Lindsay Lohan Gets More Time to Decide
Lindsay Lohan all but rejected a plea agreement on Thursday that prosecutors promised would include jail, but Judge Keith Schwartz decided to give the troubled actress another two weeks to reconsider before officially sending her to another judge and a new trial for felony grand theft.
"If you and your counsel do not accept the plea deal, then you do not have to return to this court," Judge Schwartz told Lohan during the brief hearing. If she rejects the prosecutors on March 25, then a preliminary hearing will take place on April 22 with Judge Stephanie Sautner at the helm.
The exact terms of the plea deal were not disclosed, but Lohan was on probation in January when a Venice jewelry store accused her of taking a $2,500 necklace. She pleaded not guilty to the charge.
Judge Schwartz made it clear during their last meeting, on Feb. 23, that "this case does involve jail time" if she pleads guilty. But on Wednesday, RadarOnline.com reported that Lohan's attorney, Shawn Chapman Holley, was insisting on a plea deal with no jail time.
The judge said he would sentence her to a minimum of 60 days, but likely no longer than 90 days. He "encouraged Holly to discuss what not taking the plea deal will mean for her."
Lohan was officially charged during a hearing on Feb. 9. After pleading not guilty, Judge Schwartz lanced into the actress for not taking the charges seriously. "If you violate the law again, I will remand you with no bail," he told her. "Things will be different."
If this goes to trial and she is convicted, Lohan could be sent to a California state prison with a maximum sentence of three years behind bars.
The actress, who remains on probation in a 2007 drunken driving case, is accused of taking a necklace from Kamofie & Co. of Venice Beach, Calif., on Jan. 22, roughly three weeks after the actress was released from three months of court-ordered rehab at the Betty Ford Center.
A police report was filed the day of the incident, and authorities reportedly waited until she was photographed wearing the necklace before deciding to pursue charges. A friend of the actress turned the necklace in to the Pacific Division of the LAPD on Feb. 2.
Lohan's lawyer has denied the charges, and the actress claims that the necklace was loaned to her -- and that, unbeknownst to LiLo, her stylist simply forgot to return it in time. The star's dad, Michael Lohan, told PopEater at the time that the entire incident was as a "ridiculous" misunderstanding.

Only in America does a guilty person has the opportunity to wait in and time to decide. CAN WE PUT HER AND SHEEN IN THE SAME CELL? Better yet, can we get ride of them ?

WHY does SHE get TIME to "DECIDE"??? If it were anyone else besides this so called "celebrity" the decision would have been made for us by the judge. The judge said she wasn't special and would be treated like anyone else....yeah RIGHT Judge B.S. Schwartz.

Lohan brought a friend into the store with her, the friend kept the clerk busy while Lindsay stole the necklace and later was seen wearing it. The store reported it stolen within a couple of hours. Get real!! she stole it just like she stole a mink coat & another necklace from Harry Winston. Its on tape and she doesn't have a chance of not being convicted. She and her parents are all idiots and loosers.

So, let's recap -- she was supposed to decide today, and the news I saw said she rejected to plead guilty -- so they're giving her two more weeks to "decide." How many chances does this idiot get? Put her on trial and throw her sorry butt in jail. This is almost as ridiculous as the Charlie Sheen debacle.

they are setting a very bad precedent here , noe every criminal will want extra time to decide if they want to go foe stealing and if they dont give it to them its discrimination

No way will she beat this in court. You'll never find 12 jurors without an agenda or bias and she's pissed all the judges off. She needs to take the deal and spin it. 60 -90 days equals one or two weeks. The max at trial is 3 years That's a no brainer....but so is lilo

I am tired of this girl, tired of her excuses, tired of her entitlements, and I am sick and tired of having to pay for her and her continued flagrant violations of the laws. If this was you or I we would be locked up for a few years allready and never even of had the opportunity to steal the necklace as we would of been in jail.

Melannie - innocent until proven guilty. You do realize they have a video of her putting the necklace on and then putting her own necklace over it and walking out of the store with the stolen necklace on don't you? When you have the thief on tape stealing the necklace, you don't really need a trial to prove that person is a thief.

Jury trail or not she will probably get aquitted as remember it only takes one person as in O.J. found not guilty. I would opt for a jury trail and take my chances. Her and her attorney did not opt for a plea as the judge guarantted jail time, which he should have kept his pre-opinion to himself!

i think she's pretty stupid not to take the deal! the store reported the theft the day she took it ! so her excuse of forgetting to return something that was already reported stolen !ain't gonna fly ! and you can blame all the people in the world for your problems ! but if it were true ! you would'nt be the only one going to jail !

If I walked out of any store with merchandise like that I would get slapped into jail without so much as a blink of an eye. Stores are strict about shoplifting. The judge in this case said he wasn't going to treat her any different from us BUT in fact already has. Only a celebrity would get additional time to decide for an offense that would get anyone else thrown into jail immediately without having the luxury of being able to make that same decision. This whole thing is a total farce. In a way I hope she chooses trial and then gets a guilty verdict so she goes away for a while so we don't have to be constantly seeing her face on the TV. She is a has-been who doesn't know her 15 minutes of fame ended long ago. Gotta wonder what it is going to take for her to get that through her head?

Really do they really need 5 armed cops. They are already spending more time on this than it's worth. They should drop the charges just because all the B.S. she has been through with this waste of time and get those cops back on the street and have them go after the real menaces to society.
