Halle Berry Drops Out of Broadway Play Due to 'Custody Issues'

She was scheduled to make her Broadway debut in September, but Halle Berry has just dropped out of a highly anticipated play. In a statement, the producers of 'The Mountaintop' attribute the cast change to their former star's "custody issues."

The New York Times reports that Samuel L. Jackson is still on board to portray Dr. Martin Luther King, Jr. The drama -- award-winning playwright Katori Hall's imagined account of the night before Dr. King's assassination -- would have seen Berry portray a maid at the Lorraine Hotel in Memphis, where King and his colleagues were preparing for a demonstration before King was shot on the balcony outside his room.

Producers said Berry will "not be appearing in the role due to child-custody issues."

The Oscar winner has been in a long, at times contentious custody battle with her ex-partner, French-Canadian model Gabriel Aubry, the father of their 3-year-old daughter, Nahla. The couple split in April 2010; Berry has been dating actor Olivier Martinez since last fall.

Her legal drama has interfered with her career before. Berry had to drop out of Gary Marshall's ensemble film 'New Year's Eve,' before rejoining the cast in February when a judge ruled she would be allowed to travel with Nahla to the shoot in New York. She reportedly lost her original role to Katherine Heigl, who stepped in when Berry left the project, but will now portray a nurse in the movie, opening in December.

I don't see what the problem is... They should share custody and he should get a real job. Don't allow him to sue for child support Halle... Make him do what all father's should do. Help pay for the child's needs. Otherwise, sharing is the right thing to do. You knew it would be stupid and you did it anyway. I mean, making a baby with a poor guy...

If he's granted custody, then she *does* need to pay support, just like he should if the tables are turned. How do you know he hasn't been modeling/working since the split? Models get paid pretty well, so how do you know what his bank account looks like? He may not have near the bank account that she does, but I think it's unfair to label him as "poor". You're implying that Halle lowered her standards by having a relationship/baby with someone who may have a smaller bank account. Maybe not everyone is as shallow as you seem to be, and sees the bigger picture. Money is nice, but it's not everything. True love isn't measured by how many dollars you have in your pocket, you know.

I agree they should share custody and deal with this as adults. But Gabriel has been working and is at the moment working and is not poor either. Check his site. And he is not asking for support just shared custody.

Thank god somebody has some sense, when Halle started this relationship she said she feels more married now than she did with her husbands. Said nothing bad about him, in fact the reverse.
How many posters go on about money and who earns what, this is about a childs future.

The child needs the daddy as well, it would be such a sad thing if the child only saw the weirdness of Miss Halle Barry....trouble is, Halle believes her own crap...time for her to grow up.She is more concerned with being laid than what is truly good for her daughter. Aside from Nahla, I bet Halle regrets getting involved with that dude. He's an opportunist who hit the jackpot with her. She would have been better off going to the sperm bank. And please, he wasn't that big of a model. Hardly anyone had even heard of him until he bedded Halle.

Like she didn't use *him*? Please. She wanted the world to know that she could attract and was sleeping with a gorgeous model and wanted a gorgeous man to father her child. If she didn't go after him for his bank account, why else do you think he was targeted? It wasn't *just* for his stunning personality. All that this woman seems to want is to sample the many different "flavors of the month"......when she starts getting bored, it's time to latch onto another bed partner for awhile. If that's the case, then Gabriel should be granted sole custody. She started seeing her current "flavor" as soon as she & Gabriel broke up....which means that more than likely she was seeing him on the side. Sorry, but she acts like a skank to me.

He most likely was better know in Canada. I believe he is trying to do what is best for his daughter. Halle could travel around the world with the child and he would lose his relationship with his daughter. When she starts school - even pre-school she needs to be living with someone who doesn't constantly venture beyond the home base.

He's a gold digger, he and Britney Spears' Ex are professional gold diggers, and I hear that fool is about to have ANOTHER child. Is anyone checking for STD's in hollywierd? Those ppl change partners more than they change their underwear, and they seem to "rotate" through the clique.

Unless you know Halle personally, know this first hand, you can't really say you know this is true. People say a lot of untrue things about celebs and other people. How would you like it if they said the same about you? Putting the shoe on the other foot doesn't feel so good, does it? I'm not saying anything for or against either of them. Just that people who aren't involved should keep they're opinions to themselves.
