Lindsay Lohan Guilty of 'Poor Judgement,' Not Probation Violation

After testing positive for alcohol,
Lindsay Lohan arrived in court this morning for a probation violation hearing -- a legal bout that was apparently never even supposed to take place.
After facing Judge Stephanie Sautner, in what looked like could have resulted in jail time for Lohan, it was ruled that the starlet would get off scot free -- but only on a technicality. Before being placed under house arrest, Lohan was ordered to adhere to controlled substance testing, not alcohol testing. On top of that, Lohan's substance testing was only supposed to take place between February 3 and February 25.
But the judge did rule that Lohan is only permitted one friend to visit her Venice, California home at a time. She is also forbidden from hosting any parties. According to Sautner, the only thing Lohan is guilty of is "extremely poor judgement," according to
TMZ.
Lohan's lawyer, Shawn Chapman Holley, was all smiles after the court appearance telling reporters, "I feel like you guys are disappointed ... [Lohan's] done nothing wrong. She's done everything right. So let's give her credit for that."
The forthcoming 'Gotti: Three Generations' star was tested twice last week for drugs and alcohol (tests that have now been deemed superfluous) while serving her sentence under house arrest, when she tested positive for alcohol, setting off a media firestorm. She is currently serving a four month house arrest sentence for stealing a necklace from a Venice, California jewelry store -- a sentence that is supposed to culminate next week, on June 29.
Lohan also seemed to be in high spirits following her hearing: "Thank you to all my fans for your support. Sending you Love and Light. xo," she
tweeted.
But other stars are less than thrilled with Lohan's lack of punishment: "What has happened to the justice system in the sate of California seem like all you have to be is famous & they let you get away w/ murder,"
Kelly Osbourne tweeted.
So what's one thing that Lohan did get out of her unnecessary court appearance? She finally nailed appropriate court attire. The troubled actress arrived at the LAX Airport Courthouse sporting black trousers, a button down shirt, aviators and a high ponytail -- a far cry from her previously revealing court get-ups.

Look how well drinking and driving went for Ryan Dunn. Unfortuately, he took somebody with him. Never get in a car with a drunk.

To prove both the seriousness of her transgression and the resolve of the judge, Lohan should have both wrists slapped and then a finger waved in her face while being told this is not a joke.

Until she hits rock bottom, she will never get well. But no one, especially Lohan, should EVER up on getting sober.

She should have been allowed to drink at home. It isn't a crime. You can be an alcoholic and a parent or an alcoholic and a teacher. If she drives while drinking that is another story. Trying to ask someone with an alcohol problem to stop drinking at home is ridiculous. Probation should never mandate a rule that attempts to make illegal what is legal. These types of rules are generally unenforcable and a waste of taxpayer's money. Test for "illegal" drugs and if positive, enforce consequences.

So instead of jail she should be home drinking and partying while anyone else would be behind bars? Her crimes are a result of her addictions and you think she should keep drinking? Wow.

This young lady continually sticks her finger out at the legal system. It's difficult to tell who is the most at fault...her or the judges!

WHY EVEN WASTE THE COURTS TIME AND TAXPAYERS MONEY SINCE SHE WILL NOT GO TO JAIL, AND IF SHE DOES, IT WILL ONLY BE FOR A FEW HOURS OR A FEW DAYS, MAYBE SHE WILL POST BOND OR NOT EVEN SHOW UP. WHY HASN'T HER LAWYER DROPPED THIS FOOL AS A CLIENT

Lawyers won't drop her they are making money from all of this. what they need to do is put her in jail again and keep her. making her pay the expenses that will be incurred from sitting there. PLUS INTEREST WOULD BE NICE.
why bother to appear in court, all she will get is a day behind bars or a slap on the behind. as many times as this woman have down the oposite of what the courts told her to do, she should have been behind bars for a long time like most people who dont have money to pay lawyers. i think its a shame that our judicial system favors the ones that have money or fame. if jane dow continued to do as she did, she would be wearing srips for at least 3 years.

Wonder what kind of odds I can get on whether or not she lives to see 30? Or if anyone will care when she dies? So sad, but all her own fault.

The test done on June 13th was administered just after Lindsay had a rooftop barbecue party on June 12. The Probation Department tried to force Lindsay to take two tests in May but Lindsay's lawyer, Shawn Holley, refused to make Lindsay submit, claiming it wasn't part of her probation. Turns out it was, so Lindsay subsequently took test which she failed.
SHE KNEW IT WAS PART OF HER PROBATION, BUT DID IT ANYWAY!!!! If that isn't flagrant behavior, I don't know what is!

Famous people seem to be judged under a different standard that us ordinary folks. We would have been in jail long ago.
