Halle Berry Accuses Ex Gabriel Aubry of Neglecting Their Daughter

The custody fight between Halle Berry and ex-boyfriend Gabriel Aubry over daughter Nahla is still going strong, UsMagazine.com reports. Berry made an appearance in family court on Tuesday and accused Aubry of violating an April custody agreement regarding their 3-year-old daughter.

Laura Wasser, Berry's Hollywood heavyweight attorney, submitted lengthy documentation focusing on Aubry's parenting skills. TMZ.com reports the Academy Award-winning actress alleges that Aubry neglected his daughter during an overseas visit and put her safety at risk.

The 44-year-old actress requested the judge rule that Aubry violated the agreement. Since he was not in court, the judge set a hearing for a later date.

Berry and Aubry first began fighting over custody in January. "Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her," her rep told UsMagazine at the time.

"Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter's best interest," the rep added.

Berry and Aubry broke up in April 2010 after several years of dating.

A daughter needs her father. If she cares about her daughter, she will make it easy for them to have a relationship together. Unless he is truly neglecting the girl where she is put at peril psychologically or physically, Halle should not try to look for reasons to make their father/daughter time together strained.
Maybe she knows of some issues he has, maybe he is a coke/crack head, maybe she heard about a party he was at or that he left the little girl alone in a hotel or at his place and that's why she worries for her daughters safety- who knows?

If she knew he was a crackhead or something, don't you think she would have screamed it from the rooftops by now to get her way? Instead she is listing things like "letting Nahla have pizza on her non-cheat days". WTF? I'm sorry, but i think having a three-year-old on cheat and non-cheat days sounds pyscho and dangerous. I'm beginning to think she's nuts!!

I agree well said.

From raising kids from my divorce and now their grwon up I can say for myself how important is for both boys and girls self esteem and trusing ability.
I hope she has real concerns, not just control or jealousy.

She doesn't "NEED" her father but that would be nice. if her health/safety is at risk then she definitely doesn't "NEED" her father

Dunno, she just sounds like a bitter woman...with money enough to kick up dirt to me.

...kinda sad, only one who will suffer is the little one.

IF any of this is true,it sounds to me like Halle is just a drama queen. Seems like she just wants the poor little baby all to herself. Very selfish.

Something is wrong with Halle Berry, she suppose to be so beautiful and sexy, but yet she can't keep a man. Every man she was with either abused her or cheated on her or used her. Even a beautiful woman can't keep a man. She needs to pick better. Just because your beautiful and all the man want you, doesn't mean their going to treat you right, pick more wisely. Then again maybe its not the man but maybe its Halle who's messed up and men can't stay with her.

What does her (Halle)being abused at any point make it where she does not want to speak out for her fears for her daughter. She may not want to publicly ridicule him. We must remember that it is what is in the best interest of the child that matters.

While we non do not know all...stay tune believe she has her reasons foe what she is sayings.

Hopefully Halle is not just being a bitter person against him. It gets you nowhere!!!

Don't celebrities have enough money to have a nanny 24/7? But on the other hand, it shouldn't be about nannies caring for the children, it should be about Mom having time for the child when it is her time, and Dad having time on his. Divorced parents have enough time when the kids aren't with them to do "adult things".

i totally agree. If you love your children, you will love spending time with them. I have 2 children, and I am with them all the time. If I go out to a movie with my husband, I have a wonderful time; but i am always so so so excited to reunite with my babies. They are my worlds, the and my husband. That is how it should be. If you cannot love or care for your children, don't get pregnant or impregnate.

It's awful funny Halle never said he was a neglected the child until after they broke up . I am a mom myself and am really surprised Halle is doing this
