Halle Berry Accuses Ex Gabriel Aubry of Neglecting Their Daughter

The custody fight between Halle Berry and ex-boyfriend Gabriel Aubry over daughter Nahla is still going strong, UsMagazine.com reports. Berry made an appearance in family court on Tuesday and accused Aubry of violating an April custody agreement regarding their 3-year-old daughter.

Laura Wasser, Berry's Hollywood heavyweight attorney, submitted lengthy documentation focusing on Aubry's parenting skills. TMZ.com reports the Academy Award-winning actress alleges that Aubry neglected his daughter during an overseas visit and put her safety at risk.

The 44-year-old actress requested the judge rule that Aubry violated the agreement. Since he was not in court, the judge set a hearing for a later date.

Berry and Aubry first began fighting over custody in January. "Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her," her rep told UsMagazine at the time.

"Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter's best interest," the rep added.

Berry and Aubry broke up in April 2010 after several years of dating.

No one truly knows what is going on. All we know is what the MEDIA puts out there. I'm sure we're all smart enough here to know that the majority of what we read about any celebrity and their family is either false or extremely fabricated. Hopefully they are putting their feelings for each other aside and doing what is in the best interest of the littl girl they brought into the world together

Halle Berry has a history of mental problems, what she says should be taken with caution. A decent mother would want there child to have a relationship with there father. The accusation seem very vague. Children happiness should be priority one, not being used as a tool to get at an ex or money!

Halle seems to have issues. if you can remember what her first husband former baseball player, David Justice said, Halle wants a father not a husband. Their seems to be a void in Halle's life.
Now the father of her child is neglecting his daughter. I think Halle wants this man out of her life. Just an observer on yje outside giving my opinion.

She makes it the public's business by dragging her life through the courts every 3 weeks! I've never read anything about him hitting a car and running then hiding from the police till a blood alcohol test would be inconclusive, she has! She's treading on thin ice when she points the finger at someone else after some of her unstable actions.

Halle has a history of instability in her own life. If she stayed with this last guy 3 years without the sanctity of marriage and had a child with him, he must of been OK during those times together. It wasn't until they broke up she began the court room drama. It is evident she wants his visitation to be stopped. Unless he has a drug problem or is the worst parent in the USA why would she cheat her child out of a relationship with her Daddy? This child is old enough to suffer from not seeing him. What is she doing to her baby? Cheat and Non Cheat days....is she trying to give her an eating disorder at 4? The court better take a strong look at her parenting!

I started losing respect for this woman when she won her Oscar and had to turn it into a huge race issue. Ever since she has had this little girl, she has been fighting with the dad. I think she is a control freak and so used to getting her way because of her looks that she will not stop until she gets her way.

I missed the part of the story that states she testified in Court that her daughter is on a diet of " cheating " and " non-cheating " days! But I wonder if that isn't just a rumor and not sworn testimony. What I did NOT miss is Mr. Aubrey didn't show up in Court. Maybe it's the way California does things but I know for a fact that in S. Carolina, Georgia and Florida if there is a child custody hearing and one parent fails to appear, full custody is granted to the parent who DOES appear! Since he is such a great Dad, one would think he'd appear at any hearing during which the other parent is requesting full custody, espcially against a Mother who seems to be known as unstable.

The issue on Nahla eating pizza on "non-cheat days" is in a different article. Halle got all she wanted, baby Nahla, out of her relationship with Aubry. Halle is used to getting her way, so now she's furious because she is over Aubry, and wants him to disappear. She did not count on him loving his daughter and not going away after he was told to! So, for no good reason, Halle is trying to make crazy accusations and strip Nahla's Dad of his parental rights. Halle probably planned an "emergency" custody hearing when Aubrey was out of the country, so he couldn't be at Court. I'm sure his attorney was there for him though. Now I wonder if Halle's Dad really "abandoned" her, or if Halle's Mom pulled this stunt on her Dad? I really used to like Halle, but after all this nonsense . . . I think she's got a screw loose. Halle's the one that's harming Nahla. I hope the Judge sees thru her scheme and Orders her to back off.

Shes only mad cause they broke up. He was ok to date for awhile now hes not good enough to be around his daughter. I think she has a vendeta against him now lol. She know3s she has more money then him and can drag him to court any time she wants, she should get a life.

Halle is a control freak. She is just trying to keep her daughter to herself. I find it hard to believe that the father would let anything happen to his little girl. That is why Halle has had so many bad relationships in her life. It is her not them. Let the man be a father.
